These Terms of Service explain the terms that apply when you access prfrm1.co.uk, create an account, place an order or use our services. Please read them together with our Privacy Policy, Shipping & Delivery Policy and Refund & Returns Policy.

Nothing in these Terms limits rights that cannot lawfully be excluded, including your statutory consumer rights.

1. About PRFRM 1

PRFRM 1 is a recovery and wellness technology brand offering red and near-infrared light products and related performance-recovery products.

2. Using Our Website

By using our website, you agree that you will:

use it only for lawful purposes;
provide accurate and complete information;
not attempt to damage, disrupt, reverse-engineer or gain unauthorised access to our website or systems; and
not use the website in a way that infringes another person's rights.

You are responsible for maintaining the confidentiality of your account credentials and for activity carried out through your account. Contact us promptly if you suspect unauthorised access.

3. Product Information

We take reasonable care to ensure that product descriptions, specifications, images, prices and availability information are accurate. However:

colours and appearance may vary slightly because of screen settings;
lifestyle imagery or renders may be used to demonstrate product use;
minor specifications, packaging or included components may change where this does not materially reduce the product's quality, performance or fitness for purpose; and
availability may change before an order is accepted.

Any product supplied will remain subject to the description and material information provided when your order was placed. Your statutory rights are not affected.

4. Product Use and Health Information

PRFRM 1 products are intended for wellness, recovery routines and personal use. They are not medical devices unless we expressly state otherwise.

Our products and website content are not intended to diagnose, treat, cure or prevent any medical condition and are not a substitute for professional medical advice. Follow the supplied instructions, warnings and contraindications. If you have a medical condition, are pregnant, use photosensitising medication or are uncertain whether a product is suitable for you, seek advice from an appropriately qualified healthcare professional before use.

5. Orders and Contract Formation

When you submit an order, you are making an offer to purchase the products in your basket. An automated acknowledgement does not necessarily mean that we have accepted the order.

The contract is formed when we send confirmation that we have accepted your order. We may refuse or cancel an order before acceptance where reasonably necessary, including because of:

unavailability;
an obvious pricing or product-information error;
payment failure;
suspected fraud or misuse;
delivery restrictions; or
a legal or regulatory requirement.

If we cancel an order after taking payment, we will refund the amount paid for the affected product.

6. Pricing and Payment

Prices are displayed in GBP unless otherwise stated. Any taxes applicable to the sale, delivery charges and optional service charges will be shown before you submit the order.

Prices may change, but a change will not affect an order already accepted except where the displayed price was an obvious error that you should reasonably have recognised. If that occurs, we will contact you and give you the option to proceed at the correct price or cancel for a refund.

You must provide complete and accurate billing, delivery, payment and contact information. Payments are processed through Shopify and the payment provider selected at checkout. PRFRM 1 Ltd does not store complete payment-card details.

7. Shipping and Delivery

Delivery availability, charges and estimates are explained on the relevant product page, at checkout and in our Shipping & Delivery Policy.

Delivery estimates are not guaranteed appointments unless we expressly agree a specific date. We remain responsible for goods while they are being delivered by a carrier arranged or offered by us. Risk normally passes to you when you, or a person nominated by you other than the carrier, takes physical possession of the goods.

8. Cancellation, Returns and Refunds

Your cancellation, return and refund rights are explained in our Refund & Returns Policy.

For eligible online consumer purchases, you normally have 14 days after delivery to tell us that you wish to cancel and a further 14 days to return the goods. Exceptions and conditions may apply. This does not affect your rights if goods are faulty, not as described or otherwise fail to conform to the contract.

9. Faulty Goods and Statutory Rights

Products must be of satisfactory quality, fit for purpose and as described. If a product does not conform to the contract, you may be entitled to remedies under the Consumer Rights Act 2015, which can include rejection, repair, replacement, a price reduction or refund depending on the circumstances and timing.

10. Manufacturer Warranties

PRFRM 1 products include the following manufacturer warranties:

CORE: 3 years;
BEAM: 3 years;
DESK: 3 years;
FLOW: 3 years; and
SKIN: 1 year.

Warranty coverage does not normally include accidental damage, misuse, use contrary to instructions, incorrect installation, unauthorised repair or modification, water damage, use of an unsuitable power supply or normal wear and tear.

A manufacturer warranty is additional to, and does not replace or restrict, statutory consumer rights.

11. Reviews, Feedback and User Content

If you submit a review, photograph, video, comment or other content, you confirm that you own it or have permission to submit it, that it is accurate where it describes your experience, and that it does not infringe another person's rights or contain unlawful, misleading or harmful material.

You retain ownership of your content. You grant PRFRM 1 Ltd a non-exclusive, worldwide, royalty-free licence to host, reproduce, adapt for formatting, publish and use that content in connection with our website, products, customer communications and marketing. You may contact us if you want us to stop using content you submitted; legal or technical limitations may apply.

We may moderate or remove content that breaches these Terms or applicable law.

12. Intellectual Property

The website and its logos, product names, images, graphics, videos, written content, software, design and other materials are owned by or licensed to PRFRM 1 Ltd and are protected by intellectual-property laws.

You may use the website for personal, non-commercial shopping and information purposes. You must not reproduce, distribute, modify, scrape, commercially exploit or use our content or branding without permission, except where the law permits.

13. Third-Party Services and Links

Our website uses or links to third-party services, including Shopify, payment providers, delivery providers, review services, analytics tools and social-media platforms. We are not responsible for third-party websites or services that we do not control. Their own terms and privacy notices apply.

14. Shopify Platform

Shopify provides the ecommerce technology used to operate our store, checkout, payments, accounts and related services. Information about the processing of personal information is available in our Privacy Policy and Shopify's consumer privacy policy.

15. Prohibited Use

You must not use our website to:

break applicable law or infringe another person's rights;
introduce malware or malicious code;
attempt unauthorised access or interfere with website operation;
collect information about other users without authority;
impersonate another person or organisation; or
place fraudulent orders or misuse promotions, reviews, accounts or payment systems.

We may restrict access or cancel affected activity where we reasonably believe these Terms have been breached.

16. Our Responsibility to Consumers

We are responsible for loss or damage that is a foreseeable result of our breach of these Terms or failure to use reasonable care and skill. Loss is foreseeable if it was obvious that it would happen or both parties knew it might happen when the contract was formed.

We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or breach of your statutory rights.

Products sold to consumers are supplied for private use unless otherwise agreed. We are not responsible for business losses, including loss of profit, revenue, opportunity, data or business interruption, arising from consumer use of a product.

17. Events Outside Our Reasonable Control

We are not responsible for delay or failure caused by an event outside our reasonable control. If such an event materially affects an accepted order, we will take reasonable steps to minimise the impact, provide updates where appropriate and explain any cancellation or refund rights that apply.

18. Changes to These Terms

We may update these Terms to reflect changes to our products, services, website or legal obligations. The version that applied when an order was accepted will continue to govern that order unless a change is required by law or you agree otherwise. The current version applies to future website use and orders from its effective date.

19. Severability and No Waiver

If any part of these Terms is found unlawful or unenforceable, the remaining provisions will continue to apply. A delay in enforcing a right does not waive that right.

20. Governing Law and Courts

These Terms and contracts with PRFRM 1 Ltd are governed by the laws of England and Wales.

If you are a consumer resident elsewhere in the United Kingdom, you retain any mandatory protections provided by the law of your place of residence and may be entitled to bring proceedings in your local courts. Nothing in this section removes rights that cannot lawfully be excluded.
